DUANE M. BYERS joined Nixon & Vanderhye in June 1989. Prior to that time, he was an attorney with the law firm of Cushman, Darby & Cushman. Mr. Byers has extensive intellectual property experience in patent and trademark litigation, patent and trademark prosecution and inter partes practice before the U.S. Patent and Trademark Office and a number of foreign trademark tribunals. He also has experience in copyright, trade secret and unfair competition matters. He is a registered Patent Attorney and is admitted to practice in a number of state and federal courts, including the United States Court of Appeals for the Federal Circuit.
Mr. Byers' patent, trademark and trade secret litigation activities have involved the representation of various multi-national corporations in over twenty state and federal courts, with discovery spanning North America, Europe and Asia. His trademark practice is both domestic and international, including prosecution experience in seventy (70) countries and opposition experience in ten (10) countries. His patent experience encompasses both chemical and electromechanical technology. His broad litigation and prosecution experience is also utilized in his opinion and licensing work.
Mr. Byers graduated with distinction from the University of Virginia in 1980 with a Bachelor of Science degree in chemical engineering and was admitted as a member in Tau Beta Pi, the National Engineering Honor Society. From 1980 to 1983, he was employed by DuPont as a chemical engineer in its Petrochemicals Department. While working for DuPont, he participated in the research, development and exploitation of a number of different technologies, including emulsions, geotextiles and explosives. His DuPont activities also involved the licensing and transfer of various technology to multi-national companies based in South America, Europe and Asia.
Following his work as a chemical engineer with DuPont, Mr. Byers attended law school at the University of Virginia. While in law school, he was selected as an editor of the Virginia Tax Review. As a member of the editorial board, he authored and revised legal articles concerning U.S. tax law.
Mr. Byers is a member of the Virginia Bar, the Federal Circuit Bar Association, the American Bar Association, the International Trademark Association, the American Intellectual Property Law Association, the American Chemical Society and the American Institute of Chemical Engineers.
